1. Agreement to Terms

By downloading, accessing, or using the Biteright mobile application (the "App") and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Biteright ("Company," "we," "us," or "our") reserves the right to modify these Terms at any time. Your continued use of the Service after modifications constitutes acceptance of the updated Terms.

2. License & Use

2.1 License Grant

We grant you a limited, non-exclusive, non-transferable license to download and use the App on your personal device for personal, non-commercial use only.

2.2 Restrictions

You agree not to:

• Modify, reverse-engineer, decompile, or disassemble the App
• Remove copyright or proprietary notices
• Use the App to develop competing services
• Rent, lease, lend, or resell the App
• Access the Service through automated means (bots, scrapers)
• Attempt to gain unauthorized access to our systems
• Transmit viruses, malware, or harmful code
• Violate any applicable laws or regulations

3. User Accounts

3.1 Account Registration

To use Biteright, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.

3.2 Eligibility

• You must be at least 13 years old (or older if required in your jurisdiction)
• You are responsible for ensuring your use complies with local laws
• You may not have multiple accounts

3.3 Account Termination

We reserve the right to terminate or suspend your account if you violate these Terms, engage in illegal activity, harass or harm other users, or provide false information.

4. User Content & Meal Photos

4.1 Your Content

You retain all rights to photos and information you upload. By uploading meal photos and data to Biteright, you grant us a worldwide, royalty-free license to store and process your photos, use photos with AI services for meal identification, display photos in your meal history, and use anonymized data for service improvement.

4.2 Content Restrictions

You agree not to upload illegal content, content that violates third-party rights, explicit or offensive content, personal information of others without consent, or malware.

5. AI-Generated Information

5.1 Accuracy Disclaimer

Biteright uses artificial intelligence (Google Gemini API) to analyze meal photos and provide nutritional information. This information is generated by AI and should not be considered a substitute for professional nutritional or medical advice.

5.2 No Medical Advice

Biteright does not provide medical, dietary, or health advice. Always consult with qualified healthcare professionals before making significant dietary or health changes.

6. Health & Safety

Biteright is a personal nutrition tracking tool, not a medical device or health service. We do not diagnose conditions, prescribe treatments, provide medical advice, or guarantee health outcomes. You are responsible for your health decisions.

7. Intellectual Property

All content, features, and functionality (including design, text, graphics, logos) are owned by Biteright or our licensors and are protected by copyright, trademark, and other laws. You may view and print content for personal use only.

8. Limitation of Liability

8.1 AS-IS Disclaimer

THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 Liability Cap

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR LIABILITY IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE OR $100 USD. IN NO EVENT SHALL WE BE LIABLE FOR LOST PROFITS, LOST DATA, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

8.3 Indemnification

You agree to indemnify and hold harmless Biteright, its officers, employees, and agents from any claims, damages, or losses arising from your use of the Service, violation of these Terms, or content you upload.

9. Third-Party Services

Biteright integrates with third-party services including Google OAuth, Google Gemini API, Cloudflare R2, and SendGrid. These third parties have their own terms and privacy policies. We are not responsible for their services or policies.

10. Service Availability

We do not guarantee the Service will be available 24/7, error-free, or compatible with all devices. We may perform maintenance that temporarily interrupts the Service. We are not liable for service interruptions, downtime, or data loss.

11. Payment & Pricing

Biteright is currently free. Future premium features may require payment. Charges will be clearly disclosed before purchase. Subscriptions auto-renew unless canceled. Refunds are subject to App Store policies.

12. Privacy

Your use of Biteright is governed by our Privacy Policy. Please review it carefully.

13. Governing Law & Disputes

13.1 Governing Law

These Terms are governed by the laws of India and applicable international laws, without regard to conflicts of law principles.

13.2 Dispute Resolution

• Informal Resolution: Contact us at legal@biteright.io to resolve disputes
• Arbitration: Any legal action must be resolved through binding arbitration, not court
• Small Claims Exception: You may pursue claims in small claims court

13.3 Class Action Waiver

You agree not to participate in class action lawsuits against Biteright. Disputes must be resolved individually.

14. Changes to Terms

We may update these Terms at any time. Changes become effective when posted in the App, the "Last Updated" date is changed, or significant changes are emailed to you. Your continued use after changes constitutes acceptance.
